By the order dated 20.12.2011 this court had raised specific queries as to what
action had been taken against the Principals and Managers of the aided and
un-aided institutions where mass copying had taken place.
We find that though an affidavit has been filed by Secretary, Secondary
Education, Government of U.P., Lucknow on some other point in the order
that penalty has been enhanced, but on the specific query on the above point
in the orders, the affidavit is completely silent.
We would now like the Secretary, Secondary Education Board, U.P. and
Secretary, Secondary Education U.P.Government to be present in Court on
the next date of listing and to explain why there has been no reply of the
query made by the court in its order and why no action has been taken against
the Principals and Managers of the institutions as required by the aforesaid
order and other orders passed in this writ petition.
An intervener application has been filed. It will be considered on the next date
of listing.
