Greater Kashmir SRINAGAR | July 17, 2014, Thursday STATE epaper.GreaterKashmir.com Tufail Matto case Conduct ‘fair, unbiased’ reinvestigation : HC to CB ‘Ensure culprits are brought to justice’ D A RASHID Srinagar, July 16: The High Court (HC) has asked the Crime Branch (CB) to conduct re-investigation into Tufail Matto case in a “fair and unbiased manner” and ensure the culprits are brought to justice within reasonable time. A 12th class student of Government Higher Secondary School Hazratbal, Tufail was hit by a teargas shell near Rajouri Kadal and he died on the spot on June 11, 2010. He had passed his matriculation from the Radiant Public School, Malla Bagh, here. Earlier this year, the High Court had handed over the investigation of Tufail Matoo case to Crime Branch (CB) of Jammu and Kashmir Police. Observing that the incident had taken place in June 2010 and it is yet to be ascertained as to who are actual perpetrators of the crime, bench of Justice Muzaffar Hussain Attar in its order stated that “any further delay in the investigation would cast serious reflection upon the competence of the investigating agency.” Urging for a speedy investigation, the court said, “the parents of the deceased teenaged boy must be waiting for the day the accused are identified and brought to justice.” Holding that in constitutional scheme, it is the duty of the State to protect the life and liberty of its citizens, the court observed, “When an offence has been committed, it is the duty of the State to investigate the case fairly and expeditiously and ensure that the culprits are brought to justice.” Underscoring that peace is not possible without justice to those who seek it, the court observed: “It has been stated more than once that until such time justice is meted out to the aggrieved persons, there will be no peace in the society Meeting out justice to the aggrieve persons/citizens alone guarantees peace in the society”. Citing the status reports, the court observed that the investigation is being conducted in lackluster manner saying investigating agency must gear up and conclude the investigation within reason- able period of time. “In the interest of justice, time is further extended by six weeks for concluding the investigation,” the court said while listing the case for next hearing in the week commencing August 20. On February 14, this year, the High Court had handed over the investigation to (CB) of Jammu and Kashmir Police and asked it to file investigation report within eight weeks. The High Court after quashing the trial court order accepting closure report of investigation by Special Investigation Team (SIT) had directed the state Director General of Police to handover the investigation to Crime Branch. The Court of Sub-Judge (Passenger Tax Srinagar) on March 1 last year had through an order accepted the report of the SIT into Tufail Matoo case as ‘closed untraced’, following which the family had challenged the trial court order in High Court. The High court had said an officer of the rank of SP only would conduct the investigation of the case and submit status report in 8 weeks. Pointing out that the case relates to June 2010, the court had said it would be reluctant in extending time to the investigating agency except on bonafide grounds. Observing that it appears the matter has not been investigated in the direction, the court had observed, “It appears as if an attempt has been made to save certain police officials”. The court had observed that the parents have been deprived of their only son and the police cannot be permitted to abdicate its statutory duty of identifying the culprit and bringing him to justice. In a statement, Secretary SVC said on the basis of enquiry conducted by the Commission, it came to fore that Sita Devi was conferred ownership rights under Roshni Act in respect of prime state land measuring four kanals at Rajbagh after clearance by Divisional Commissioner Kashmir on June, 6 2007 on the recommendation of Nazool Department against the payment of Rs.72 lakhs to be paid by Sita Devi. The statement said the concerned Deputy Commissioner on 4th conferment of ownership rights upon Sita Devi for four kanals of land under survey No.1317 & 1318 in estate Nursing-grah, further revealed another person namely Shamsher Singh, who represented himself as an attorney holder of Sita devi, in connivance with concerned revenue authorities got the mutation entered in the mutation register in favour of Sita Devi through she was already dead. “In the Jamabandi register, deceased Sita Devi was entered as owner and the land was shown in her personal possession. Strange enough on the same date Naib Tehsildar, after entering deceased Sita Devi as the owner of the land showing the land in her personal possession, mutated the same land in the name of Shamsher Singh on the basis of a will deed which is under scrutiny,” it said. “As per the complaint the land has further been handed over by Shamsher Singh to Muhammad Younus son of Ghulam Ali Dar of Nowshera Srinagar and Hakim Zaffar Ali son of Hakim Shair Ali of Nishat under agreement to sell for a consideration of Rs 15 crores and a Commercial hotel has also been established on the land in question,” the SVC statement said. “Holding that these facts prima-facie disclose commission of a cognizable offence by the Revenue officials in connivance with said Shamsher Singh and others, the State Vigilance Commission directed the Director, Vigilance Organization to register a case against the concerned officials for thorough investigation. This apart, a reference has also been sent to the Chief Secretary of the State with the recommendation to take administrative action against delinquent officers,” the statement added.
