Greater Kashmir SRINAGAR | August 30, 2014, Saturday NEWS epaper.GreaterKashmir.com Political parties should deposit funds in banks: EC New Delhi, Aug 29: The Election Commission today virtually made it mandatory for political parties to deposit their funds in banks and not to exceed ceiling limits in financial assistance for candidates to ensure transparency and accountability. The Election Commission order in this regard under Article 324 of the Constitution (superintendence, direction and control of elections) was part a set of comprehensive guidelines on transparency and accountability in party funds and election expenditure. Under the guidelines, the treasurer of a political party is now required to ensure maintenance of accounts at all state and lower levels and consolidated accounts at the central party headquarters. The accounts maintained by the treasurer shall con- form to the guidance note on accounting and auditing of political parties issued by the Institute of Charted Accountants. The annual accounts shall be audited and certified by the qualified by certified charted accountants as required under the Income Tax Act. Under the guidelines, a party should ensure that no payment in excess of Rs 20,000 is made to any person or company in cash, except in a village or in town not served by a bank. Also it will not apply to payments made to any employee or party functionary towards salary, pension or reimbursement of expenses or where cash payment is required under any statute. The guidelines will come into effect from October one this year. Referring to the Representation of the People Act provision regarding ceiling for election expenditure of a candidate, the guidelines make it clear that such assistance from a political party shall not exceed the prescribed ceiling. "Any payment in this regard by the party shall be made through crossed account payee cheque or draft or through bank account transfer and not in cash," says one of the guidelines. While the recognised political parties shall file all reports, namely the contribution reports in Form 24A, the audited annual accounts as certified by the charted accountants and the election expenditure statements with the Commission. The unrecognised parties shall file them with the chief electoral officer of the states. The EC said in order to bring uniformity, all politi- cal parties shall submit to the Commission or to any authority mentioned by it a copy of the annual accounts with auditors report for each financial year before October 31 of each year. The Income Tax provisions do not allow any deduction on the contributions made in cash by any person or company to a political party. Accordingly, the Commission guidelines say, the political party shall maintain names and address of all such individuals, companies or entities making donation to it excepting petty sums donated by public during rallies. Further, any amount or donation received in cash, shall be duly accounted in the account books deposited in the party's bank account within a week of its receipt. However, the party can retain a reasonable amount required for day to day functioning and for defraying cash expenses. The Commission said concerns have been expressed in various quarters that money power was disturbing the level playing field and vitiating purity of elections. Noting that it is desirable for political parties to observe transparency and accountability in respect of funds raised and expenditure incurred both during elections and in other times, the Commission said it is necessary and expedient to provide guidelines for bringing that. The Commission said it sought suggestions and inputs from all recognised political parties, most of whom supported the issue of transparency guidelines. Some others had a different view. PTI Pakistan army contradicts Sharif, says govt asked it to mediate Islamabad, Aug 29: Pakistan's military today said it was the government that asked it to play a "facilitative role" in resolving the current impasse, contradicting Prime Minister Nawaz Sharif's statement that protest leaders approached the Army Chief to intervene. "COAS (Chief of Army Staff) was asked by the Govt to play facilitative role for resolution of current impasse, in yesterday's meeting, at #PM House," Major General Asim Bajwa tweeted as Sharif and pro- test leaders Imran Khan and Tahir-ul-Qadri traded charges over who was responsible for the army's intervention. Bajwa's remarks came after Prime Minister Sharif told the National Assembly today that "neither had I asked army nor the armed forces sought a role in the present political crisis." Sharif scotched media reports that it was he who "requested" the army to come to his rescue, saying it was Khan and Qadri who approached Army Chief Raheel to become a mediator. Responding to Sharif's statement, an angry Pakistan Awami Tehreek (PAT) chief Qadri shot back, "I say this categorically that the Prime Minister asked the army to intervene. I am saying, on the record, that we did not make any request asking the army to intervene." "I had not even spoken to the army chief before our meeting yesterday," Qadri said, adding that Sharif made the statement after he saw his government was losing strength. The fiery cleric claimed that Sharif was lying. Pakistan Tehreek-i-Insaf chief Khan also slammed the premier for saying Qadri and he asked for the army to intervene. "I want to tell you what I told the army chief. I told Gen Raheel that I do not trust Nawaz Sharif at all. I told Gen Raheel every reason as to why I will not leave without their resignations," Khan said, adding that PTI did not ask the army to mediate. "I am not going to backtrack on the resignation of the prime minister on any account," he said. The army had earlier asked all stakeholders in the crisis to hold "meaningful" talks to end the crisis. PTI Centre must find solution to block porno sites: SC New Delhi, Aug 29: Voicing concern over mushrooming pornographic sites on Internet, the Supreme Court today asked the Centre to find out solution to the "hydra headed" problem after government virtually expressed its helplessness, saying "if we block one site, another crops up". "Human mind is very fertile and technology runs faster then law. Law has to keep pace with technology," a bench headed by Chief Justice R M Lodha said. Additional Solicitor General L Nageshwar Rao submitted that when one site is blocked, similar multiple sites crop up. He said that government is taking steps to bring servers operating from foreign countries to India to control sites. "If we block one site, other crops up. There are also hidden servers in the country and it is difficult to control them. All social media are being operated from foreign land," he said, adding that parental control software should be provided to keep indecent material on net from children. The bench, however, said some solution has to be found out for the problem. "Law, technology and governance have to be synthesised to control pornographic materials on Internet," it said, observing, "There are rules to control such sites and some method has to be found out". The court was hearing a petition filed by Indore-based advocate Kamlesh Vaswani who pleaded that although watching obscene videos was not an offence, pornographic sites should be banned as they were one of the major causes behind crime against women. The petition filed through advocate Vijay Panjwani says that the absence of Internet laws encourages people to watch porn videos and over 20 crore porn videos or clippings are freely available in the market, which have been directly downloaded from the Internet or copied from video CDs. Heptulla was quoted as saying in a media report that "there is nothing wrong in calling all Indians Hindu. Congress reacted sharply to her reported comments with party leader Manish Tewari saying she should read the Constitution. "We respect Najmaji a lot but it would be better if she reads the Constitution. The Constitution mentions 'Bharat' and going by that every citizen of the country is a 'Bharatiya' and not Hindu," Tewari said. NCP leader Tariq Anwar criticised Heptulla, terming the reported remarks as "unfortunate". "If she has given that statement, it is very unfortunate. I think she has given the statement to ensure her continuance as a minister. She says she is from Maulana Azad's family. However, she sought to clarify her comments today, saying she had called all Indians Hindi, the Arabic term for people living in India and what she said was "not in relation to the religion but in relation to identity as nationality". She did not call them Hindus, she said. Heptulla hinted at the need of having uniformity of identity for all Indians as she told PTI that she did not think "there is any country with three names in three different languages". In Arabic, Indians are called Hindi and Hindustani and Indian in Persian and English respectively, she said."We are Hindi, we are Hindustani by identification as nationality. Hindi Indians and Hindustani are all one and the same thing," she said.
